It serves to outline, define, and communicate the guidelines and restrictions governing your use of our Services. Any violation of this policy will be considered a breach of the Agreement. Laws and Harmful Content.
When using our Services, you agree that you will not violate any state, federal, foreign, or governing law or regulation that prohibits: infringing on any intellectual property rights including but not limited to copyright, patent, trademark, or trade secret; pornography of any kind including but not limited to child pornography or erotica, non-consensual sex acts, sex trafficking, or bestiality; animal cruelty, torture, or abuse; gambling; defamation, slander, or libel; harrassing or threatening content or actions; fraud or false advertising; publishing, hosting, distributing, or promoting material or content that enables hacking, phishing, malware, spyware, adware, social engineering, or any other malicious code; sending spam or bulk unsolicited email; interference with, disruption of, or attack on any service or network.
Our Services may not be used for publishing, hosting, or distributing content that promotes hate, violence, or discrimination based on gender, sexual orientation, religion, race, or age.
Our Services may not be used by any individual, organization, or entity involved in or suspected of being involved in any illegal activities related to gambling, arms trafficking, terrorism, drug trafficking, or human trafficking.
SiteVivid adheres to a strict policy of terminating the Services for customers who repeatedly infringe upon intellectual property rights.
Regulate and Sensitive Information.
You are expressly prohibited from utilizing the Services to store or process sensitive or legally regulated health or financial information, including but not limited to any protected health Information, cardholder data protected under PCI DSS regulations, or any other form of financial data. You acknowledge, understand, and agree that we bear no responsibility for any liabilities that may arise as a result of your violation of this restriction.
Spam.
Sending Spam using our Services is forbidden and can lead to immediate account termination. Spam includes sending emails that violate current FTC regulations implementing the CAN-SPAM Act or foreign equivalents for non-domestic users. We may limit your outbound messages if your account jeopardizes our network stability. Breaching this rule by sending spam incurs a $500 charge per violation, considered a reasonable estimate of damages, not a penalty.
Resource Burdens.
You must not disrupt our business operations or hinder our ability to serve other customers, including actions that strain the network or systems. This includes refraining from using or providing open proxies, Internet Relay Chat, or engaging in video streaming using our Services. If your usage significantly surpasses that of comparable customers, we may suggest moving you to another plan or charging for the excess use. Refusal may result in usage restrictions. Conducting any form of vulnerability or penetration testing on any network or systems used by SiteVivid, including your hosted environment, requires prior written approval.
Security.
You’re required to implement sensible security measures while using the Services. You are accountable for the conduct of your Authorized Users and anyone you grant access to for using the Services or the content created through them.
3rd Party Services.
SiteVivid engages the services of 3rd Party Service Providers to provide the Services to Customer. Customer agrees to not engage in any activity or cause SiteVivid to engage any activity that infringes on any of our 3rd Party Service Providers AUP.
